Terms of Service

1. Acceptance of Terms

By creating an account, clicking an "I agree" (or similar) button, purchasing a paid service, or otherwise accessing and using Bespree ("the Service"), you accept and agree to be bound by these Terms of Service to the extent permitted by applicable law.

If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and these Terms apply to that entity. If you do not agree to these Terms, please do not use the Service.

2. Eligibility

You must be at least 16 years of age (or the age of digital consent in your country, if higher) and legally able to enter into these Terms to use the Service. By using Bespree, you represent that you meet these eligibility requirements.

3. Description of Service

Bespree provides resume creation, import, editing, export and sharing tools; optional AI features and connected-assistant access; cover-letter and interview-preparation tools; job search; career information; and employer services. Available features, limits and eligibility are described in the Service. Some features are free and others may require payment.

Platform role: Bespree is a technology platform that provides tools to support hiring and job search workflows. Bespree is not an employer, employment agency, recruiter, or staffing firm, and does not participate in employment decisions.

3.1 Advertising and Sponsored Content

We may display advertisements, sponsored content and paid placements within the Service to help support its operation. We will clearly identify paid promotional content. The availability and placement of advertising may change.

We will not use your resume content to target advertisements or insert advertisements into resumes you export from Bespree.

Any personal information processed in connection with advertising remains subject to our Privacy Policy and applicable consent and opt-out requirements. This section does not change our privacy commitments or authorize the sale of personal information or sharing for cross-context behavioral advertising. Accepting these Terms does not constitute consent to advertising cookies or personalized advertising.

A paid placement does not by itself mean that Bespree endorses an advertiser or has verified a job opportunity. Advertisers are responsible for their offers. If you choose to visit an advertiser or use its services, its terms and privacy policy apply to that interaction. Nothing in this section limits responsibilities that Bespree cannot exclude under applicable law.

4. User Accounts

4.1 Account Creation

To use certain features, you must create an account. You may register using email or an available third-party sign-in option shown in the Service. You are responsible for maintaining the confidentiality of your account credentials.

4.2 Account Responsibility

• You are responsible for all activities under your account
• You must provide accurate and complete information
• You must notify us immediately of any unauthorized use
• You must not share your account with others

5. Acceptable Use

5.1 Permitted Uses

You may use Bespree to:

• Create, import, edit, export and share resumes and cover letters you are authorized to use
• Use optional AI features and connected assistants within the permissions you approve
• Search for legitimate employment opportunities
• Create and maintain professional profiles
• Communicate with potential employers
• Post legitimate job openings (for employers)

5.2 Prohibited Activities

You may not:

• Post false, misleading, or fraudulent information
• Use the service for illegal activities
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to our systems
• Post spam or unsolicited commercial content
• Scrape or automatically collect data from our platform, except through APIs or connections we make available for that purpose and within their stated permissions and limits
• Impersonate another person, company, or entity
• Collect user data for unsolicited outreach or marketing purposes

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you submit (resumes, profiles, etc.). By submitting content, you represent that you have the rights to submit it and that it does not violate any law or third-party rights. You grant us a non-exclusive, royalty-free license to use, display, and distribute your content solely as necessary to operate and improve our services. This license ends when you delete your content or account, except where retention is required by law or for legitimate business purposes (such as backup copies or legal compliance).

6.2 Our Content

Except for user content and third-party materials, Bespree and its licensors own the content, templates, features and functionality of the Service. You may use our templates through the Service and download, copy and share the resulting resumes and cover letters for your personal or authorized professional use. This permission does not authorize you to extract or resell our template library, software or other platform materials.

7. Privacy and Data Protection

Your privacy is important to us. Our data collection and use practices are described in our Privacy Policy, which is incorporated by reference into these Terms. Some features (including AI) are optional and require your consent, which you can withdraw anytime in Settings.

8. Payment Terms

Some features require payment. We use Stripe to collect and process payments. The applicable price and service period are shown before checkout.

• Pricing: Prices are displayed at checkout and may include applicable taxes where required by law.
• Subscriptions: If we offer a recurring subscription, its renewal period, price and cancellation terms will be disclosed before purchase, and any required consent will be obtained. Employer job postings do not automatically renew.
• Refunds: Fees are generally non-refundable unless otherwise specified or required by law. See our Refund Policy for details.
• Failed payments: If a payment fails, we may suspend access to paid features until payment is successfully processed.
• Employer job postings: Job postings for employers do not auto-renew. Employers may choose to renew or extend postings manually. Prices are charged per location. Refunds are governed by our Refund Policy and applicable law.

9. Third-Party Services

The Service may integrate with third-party sign-in, payment processing and other services. Where you choose to access a third-party service directly, its applicable terms and privacy policy govern that interaction. Our use of service providers to process your personal information is described in our Privacy Policy.

10. Third-Party Job Content

Bespree displays job listings sourced from official public government data portals, such as NYC Open Data and the State of New York job vacancy system. The following terms apply to such imported content:

• Not the employer: Bespree is not the employer for any imported job listing. Bespree has no relationship with, affiliation to, or endorsement from the agencies, departments, or organizations whose job listings appear on our platform.
• No government endorsement: The display of government job listings on Bespree does not imply any endorsement, sponsorship, or official partnership with any federal, state, or local government entity.
• Accuracy not guaranteed: Imported job listings may be delayed, incomplete, or outdated compared to the original source. Bespree does not guarantee the accuracy, completeness, or timeliness of any imported listing. You should verify all information at the original source before applying.
• Original source: All imported job pages include a link to the original listing on the official source website. We encourage you to apply through the official channels provided by the hiring organization.
• Removal requests: If you represent the source agency and believe a listing should be corrected or removed, contact us with the listing link and details. We will review the request and take appropriate action, subject to applicable law.

11. AI-Generated Content

Bespree offers optional AI-powered features to help improve your resume content. AI features are opt-in and can be disabled anytime in Settings. By using these features, you acknowledge and agree to the following:

• Accuracy not guaranteed: AI suggestions may be inaccurate, incomplete, or unsuitable for your situation. Always review and verify all AI-generated content before using it.
• Your responsibility: You are solely responsible for the final content of your resume, including any content generated or modified with AI assistance.
• Not professional advice: AI features do not constitute professional career, legal, or employment advice. Consider consulting qualified professionals for important career decisions.
• Service changes: We may change AI providers, modify features, or discontinue AI functionality at any time with reasonable notice where practicable.
• Data processing: When you use AI features, your resume content is processed by third-party AI providers as described in our Privacy Policy.
• No automated decisions: Bespree does not use fully automated decision-making to accept, reject, or rank candidates without human review.

12. Disclaimers

Bespree is provided "as is" without warranties of any kind. We do not guarantee:

• Job placement or employment outcomes
• Accuracy of job listings or employer information
• Continuous, uninterrupted service availability
• Security against all possible threats
• Hiring outcomes, candidate quality, time-to-hire, offer acceptance rates, or retention (for employers)

We do not guarantee the identity of every employer or the accuracy, legitimacy or availability of every listing. Employers are responsible for their postings, hiring decisions and compliance with applicable employment and anti-discrimination laws. You should independently verify an employer or opportunity before applying or accepting employment. Nothing in these Terms excludes responsibilities that cannot be excluded under applicable law.

13. Limitation of Liability

To the maximum extent permitted by law, Bespree shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service. Some jurisdictions do not allow certain limitations; in those jurisdictions, these limitations apply to the fullest extent permitted by applicable law.

Nothing in these Terms excludes or limits liability, statutory rights or remedies that cannot be excluded or limited under applicable law.

14. Termination

We may terminate or suspend your account at any time for violation of these terms. You may terminate your account at any time by contacting us or using account deletion features.

15. Changes to Terms

We may update these Terms. We will identify the effective date and give notice of material changes before they take effect, except where a different process is permitted or required by applicable law. Changes apply prospectively. Where the law requires your express acceptance, we will request it; continued use alone will not replace that acceptance. Otherwise, continued use after the effective date constitutes acceptance to the extent permitted by law. Changes to these Terms do not replace any separate consent required for personal-data processing.

16. Governing Law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service will be resolved in the state or federal courts located in Delaware.

If you are a consumer, this choice of law and courts does not deprive you of mandatory protections or rights to bring a claim in another court that apply under the law of your place of residence.

17. General Provisions

• Survival: Sections relating to intellectual property, disclaimers, limitation of liability, and disputes survive termination of your account or these Terms.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
• Assignment: We may assign these Terms as part of a merger, acquisition, or sale of assets. You may not assign your rights or obligations without our prior written consent.
• Entire agreement: These Terms, including the connected-assistant disclosure on this page when applicable, together with our Privacy Policy and other policies referenced here, constitute the entire agreement between you and Bespree concerning the Service.
