By creating an account, clicking an "I agree" (or similar) button, purchasing a subscription, or otherwise accessing and using Bespree ("the Service"), you accept and agree to be bound by these Terms of Service.

If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and these Terms apply to that entity. If you do not agree to these Terms, please do not use the Service.

2. Eligibility

You must be at least 16 years of age (or the age of digital consent in your country, if higher) and legally able to enter into these Terms to use the Service. By using Bespree, you represent that you meet these eligibility requirements.

3. Description of Service

Bespree is a job search platform that connects job seekers with employers. We provide tools for creating profiles, searching for jobs, and applying to positions. The service includes both free and paid features.

Platform role: Bespree is a technology platform that provides tools to support hiring and job search workflows. Bespree is not an employer, employment agency, recruiter, or staffing firm, and does not participate in employment decisions.

4. User Accounts

4.1 Account Creation

To use certain features, you must create an account. You may sign up using email or through Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials.

4.2 Account Responsibility

  • You are responsible for all activities under your account
  • You must provide accurate and complete information
  • You must notify us immediately of any unauthorized use
  • You must not share your account with others

5. Acceptable Use

5.1 Permitted Uses

You may use Bespree to:

  • Search for legitimate employment opportunities
  • Create and maintain professional profiles
  • Communicate with potential employers
  • Post legitimate job openings (for employers)

5.2 Prohibited Activities

You may not:

  • Post false, misleading, or fraudulent information
  • Use the service for illegal activities
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorized access to our systems
  • Post spam or unsolicited commercial content
  • Scrape or automatically collect data from our platform
  • Impersonate another person, company, or entity
  • Collect user data for unsolicited outreach or marketing purposes

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you submit (resumes, profiles, etc.). By submitting content, you represent that you have the rights to submit it and that it does not violate any law or third-party rights. You grant us a non-exclusive, royalty-free license to use, display, and distribute your content solely as necessary to operate and improve our services. This license ends when you delete your content or account, except where retention is required by law or for legitimate business purposes (such as backup copies or legal compliance).

6.2 Our Content

All content, features, and functionality of Bespree are owned by us and protected by intellectual property laws. You may not copy, modify, or redistribute our content without permission.

7. Privacy and Data Protection

Your privacy is important to us. Our data collection and use practices are described in our Privacy Policy, which is incorporated by reference into these Terms. Some features (including AI) are optional and require your consent, which you can withdraw anytime in Settings.

8. Payment Terms

Some features require payment. We use Stripe for payment processing. By making a payment, you agree to Stripe's terms of service.

  • Pricing: Prices are displayed at checkout and may include applicable taxes where required by law.
  • Subscriptions: If you purchase a subscription, it will automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel via your account settings or by contacting us, and cancellation will take effect at the end of your current billing period.
  • Refunds: Fees are generally non-refundable unless otherwise specified or required by law. See our Refund Policy for details.
  • Failed payments: If a payment fails, we may suspend access to paid features until payment is successfully processed.
  • Employer job postings: Job postings for employers do not auto-renew. Employers may choose to renew or extend postings manually. Prices are charged per location and are non-refundable once a posting is live, except as required by law.

9. Third-Party Services

Our service may integrate with third-party services (Google, Stripe, etc.). Your use of these services is governed by their respective terms and privacy policies.

10. AI-Generated Content

Bespree offers optional AI-powered features to help improve your resume content. AI features are opt-in and can be disabled anytime in Settings. By using these features, you acknowledge and agree to the following:

  • Accuracy not guaranteed: AI suggestions may be inaccurate, incomplete, or unsuitable for your situation. Always review and verify all AI-generated content before using it.
  • Your responsibility: You are solely responsible for the final content of your resume, including any content generated or modified with AI assistance.
  • Not professional advice: AI features do not constitute professional career, legal, or employment advice. Consider consulting qualified professionals for important career decisions.
  • Service changes: We may change AI providers, modify features, or discontinue AI functionality at any time with reasonable notice where practicable.
  • Data processing: When you use AI features, your resume content is processed by third-party AI providers as described in our Privacy Policy.
  • No automated decisions: Bespree does not use fully automated decision-making to accept, reject, or rank candidates without human review.

11. Disclaimers

Bespree is provided "as is" without warranties of any kind. We do not guarantee:

  • Job placement or employment outcomes
  • Accuracy of job listings or employer information
  • Continuous, uninterrupted service availability
  • Security against all possible threats
  • Hiring outcomes, candidate quality, time-to-hire, offer acceptance rates, or retention (for employers)

We do not verify employers or job listings posted on our platform. We are not responsible for the actions, conduct, or content of any employer or third party. Employers are responsible for complying with all applicable employment and anti-discrimination laws and for the content of their postings. You should independently verify any employer or opportunity before applying or accepting employment.

12. Limitation of Liability

To the maximum extent permitted by law, Bespree shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service. Some jurisdictions do not allow certain limitations; in those jurisdictions, these limitations apply to the fullest extent permitted by applicable law.

13. Termination

We may terminate or suspend your account at any time for violation of these terms. You may terminate your account at any time by contacting us or using account deletion features.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes, and where required by law, ask you to re-accept. Changes apply prospectively from the effective date. Continued use of the service after the effective date constitutes acceptance of the updated terms.

15. Governing Law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service will be resolved in the state or federal courts located in Delaware.

16. General Provisions

  • Survival: Sections relating to intellectual property, disclaimers, limitation of liability, and disputes survive termination of your account or these Terms.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
  • Assignment: We may assign these Terms as part of a merger, acquisition, or sale of assets. You may not assign your rights or obligations without our prior written consent.
  • Entire agreement: These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Bespree.
